Terms and Conditions

GENERAL INFORMATION
Unless otherwise agreed in writing, the following General Terms and Conditions apply to all business transactions. By placing an order, you agree to these General Terms and Conditions.

Shipping Costs and Terms
Deliveries are made only to addresses in Switzerland.
Take advantage of free shipping on orders with a net merchandise value of CHF 110.00 or more

For orders with a product value below CHF 35.00, the standard shipping fee of CHF 12.00 applies.

You can reach our support team around the clock via info@bestitaliancoffee.ch. Your orders or inquiries will be processed as a priority no later than the following business day.

New Customers / First Order
First orders on account for new customers will be shipped on a prepaid basis
To minimize our risk of bad debt losses on orders placed on account, we use credit rating systems for our assessment. When placing an order on account, you will receive an online payment link with all the information needed to settle your order/invoice.

Prices
Prices in the online store include VAT; shipping and packaging costs are listed separately. Prices are subject to change without notice and may be adjusted at any time. The prices valid on the day of the order will be charged. Prices are listed in CHF.


Freshly Cut / Billed by Actual Weight
Products such as meat, vegetables, cheese, fish, etc., which are listed by weight (100 grams = CHF 7.00), will be billed based on the actual weight delivered.

Example:
You order a product listed as 100g / CHF 7.00 / 100g. 
Listing on the product details and overview page = 7.00 / 100g

- Order of 10 items at 100g each = 1 kg (1,000g) 
Shopping Cart – Complete order and pay by invoice / or with TWINT / credit card.
You will receive an order confirmation in your account that has not yet been processed internally. For card payments or TWINT, the amount will appear as a hold. 

Explanation:
You are ordering 1,000g of the product, freshly sliced, in 10 pieces of 100g each, just as you’re used to seeing at the deli counter. Depending on how it’s prepared, the weight per piece may vary slightly. The total weight may come to 1,100g (plus 100g) or 980g (minus 20g). To ensure you don’t overpay or the supplier delivers too much, the system will adjust the charges to match the details of your order. For 1,100 g, the system will charge 1,100 g × CHF 7.00 per 100 g = CHF 77.00, which covers the cost of the ingredients only. For 980g, the system will charge 980g × CHF 7.00 per 100g = CHF 68.60. This way, you pay only for what is delivered to you.

Payment Terms
The following payment methods are available in our store: MasterCard, VISA, PayPal, Google Pay, Apple Pay, PostFinance, Postcard, Sofort Überweisung, Twint, and on account.

Bank Transfer
You will receive an invoice via email immediately after placing your order. The invoice amount shown is due and payable immediately. The order will only be processed once the full invoice amount has been received.

Cash on Delivery
If you select cash on delivery as your payment method, an additional 50.00 CHF will be charged for shipping via our shipping providers.

PayPal
You pay the invoice amount via the online payment provider PayPal. You must be registered with PayPal or register first, authenticate yourself using your login credentials, and confirm the payment instruction to us. You will receive further instructions during the ordering process. Payments must be made in Swiss francs (CHF). The date on which Italian Coffee AG has access to the funds is considered the date of receipt. The buyer waives the right to offset any claims against Italian Coffee AG against the purchase price.

Late Payment
If the buyer misses a payment due date, the buyer is in default without prior notice, and Italian Coffee AG is entitled to charge additional late-payment interest of at least 6% of the amount owed. Italian Coffee AG reserves the right to rescind the contract in the event of a delay in payment by the buyer.

Discount Levels
On the account you have created or when placing a guest order on the platform italiancoffee.ch, we display the direct discount on individual products as well as the tiered pricing.

    The negotiated discounts and tiered prices are displayed directly on the products online.

Gift cards:
You can redeem a gift card on the “Checkout” page after logging in.

  • The value of a gift certificate (in CHF or %) is applied to the order total in CHF in the shopping cart (Checkout).

  • Gift certificates cannot be combined.

Gift Certificate Types:
There are various types of gift certificates.

  • Personalized gift certificates

  • One-time global gift certificate

  • Time-limited gift certificates

Disposal
Disposal of the goods is not included in the price. No recycling fee is charged at the time of purchase; this fee becomes due upon any disposal by Italian Coffee AG and is billed to the buyer based on actual costs plus handling fees.

Orders and Offers
The buyer is bound to Italian Coffee AG upon placing an order.

Orders may be placed verbally or in writing. Italian Coffee AG is not bound by the order until it has confirmed in writing that the order will be fulfilled. This is subject to cancellation by Italian Coffee AG’s supplier and cases of force majeure.
The buyer is responsible for the accuracy of the order and for ensuring that all information regarding the ordered goods is provided to Italian Coffee AG within seven days of receipt of the order. The buyer may rescind the contract only as long as Italian Coffee AG or its suppliers have not yet commenced any production activities regarding the ordered goods; Italian Coffee AG shall be held harmless for any damages or costs arising therefrom.
If the goods are manufactured or otherwise processed or treated by Italian Coffee AG and the buyer has provided specifications for this, the buyer shall indemnify and hold Italian Coffee AG harmless from any loss, damage, claim, cost, or other expense if the contractual manufacture, processing, or treatment of the goods based on the buyer’s specifications proves or has proven to be an infringement of a third party’s patent, copyright, trademark, or other intellectual property right. Notwithstanding the foregoing, Italian Coffee AG reserves the right to modify descriptions of our goods with respect to the buyer’s specifications to the extent necessary to comply with legal requirements, provided that such modification does not result in any deterioration of the order in terms of quality and usability.
Offers made by Italian Coffee AG are subject to change and non-binding; they become binding only upon written confirmation in accordance with the aforementioned provisions of these General Terms and Conditions.

Italian Coffee AG is entitled to modify and improve the goods without having to inform the buyer in advance, provided that the modification or improvement does not permanently impair or degrade either the form or function of the goods.

Delivery Time
Italian Coffee AG strives to meet the specified delivery times; however, Italian Coffee AG cannot assume any liability for them. Italian Coffee AG is not liable for cases of force majeure, which entitle it to extend any agreed-upon delivery times. Delivery times are automatically extended by the duration of the delay. Cases of force majeure include, in particular but not exclusively, operational shutdowns or outages not caused by us, strikes, or orders issued by government authorities. In the event of a delay, the buyer is obligated to grant a reasonable grace period. Claims for damages resulting from delivery delays are excluded.

Shipping and Installation (Coffee Machines)
Italian Coffee AG delivers ex warehouse at the buyer’s expense to the specified address or to the valley station. The unloading location is defined as a ground-level area, e.g., goods receiving area, loading dock, warehouse, or workshop. Transportation and installation within the building are at the buyer’s expense. For special transport, the buyer must provide, at their own expense, labor, elevators, or crane equipment. The installation site must be properly prepared. If goods need to be moved, the additional costs shall be borne by the buyer. Partial deliveries are permitted. Changes made after the order is received will be billed to the buyer as additional charges.
The goods are shipped at the recipient’s risk. In the case of delivery by truck, the driver must be notified of any transport damage immediately upon arrival of the goods. The damage must be noted on the duplicate copy of the delivery note. The LSVA tax is borne by the buyer. In the case of rail or postal transport, the recipient agrees to obtain a damage report from the carrier regarding any potential transport damage. Shipments to private individuals are generally sent cash on delivery.
If the buyer is in default of acceptance, Italian Coffee AG is entitled to arrange for the goods to be stored at the buyer’s risk and expense.
If installation and commissioning cannot be completed in a single stage for reasons not attributable to Italian Coffee AG, the additional costs shall be borne by the buyer.

Warranty and Repair Service
We are happy to refer you to an external repair service if you encounter problems with our machines. During the standard warranty period and subject to the usual warranty terms, we will cover the costs of any repairs at our official service centers that are attributable to material or manufacturing defects. An extensive inventory of replacement parts is available.

Retention of Title
All purchased items remain the property of Italian Coffee AG until full payment has been made. Italian Coffee AG reserves the right to have the retention of title registered.

Warranty and Disclaimer of Liability
Italian Coffee AG’s statutory warranty obligation for defects is hereby excluded. In its place, the buyer is entitled to free repair if he reports the defect to Italian Coffee AG during the agreed warranty period. The warranty period begins on the date of delivery. In the event of a recognized defect, Italian Coffee AG reserves the right to remedy the defect through repair or to provide a replacement upon return of the goods; any further claims by the buyer against Italian Coffee AG are reserved in the event that repair is unsuccessful even on the second attempt. Italian Coffee AG reserves the right to replace parts of the purchased item instead of performing repairs. Replaced parts become the property of Italian Coffee AG. The warranty for Italian Coffee AG’s goods does not cover product defects arising from faulty installation or use, misuse, negligence, or other causes attributable to the buyer or third parties. Furthermore, no warranty is provided for malfunctions or damage to our goods arising, in particular but not exclusively, from the following reasons:

  • Inappropriate or improper use or negligent handling of the goods by the buyer and/or third parties.

  • Improper assembly or commissioning of the goods by the buyer and/or third parties.

  • Deviations from agreed-upon or standard operating conditions, or failure by the buyer to provide instructions in accordance with these General Terms and Conditions.

  • Failure by the buyer and/or third parties to follow the operating instructions or prescribed operating data, or failure to perform the maintenance specified in the operating instructions.

  • Normal wear and tear is not considered a defect. (Example: calcification)

The warranty period is not affected by repairs but continues uninterrupted. For newly installed parts, the remaining warranty period of the replaced parts applies. The buyer has no claim for compensation for any direct or indirect damages resulting from a defect in the purchased item (e.g., lost profits, damage to goods, production losses, etc.).
The buyer is obligated to inspect the goods immediately upon receipt for completeness, correctness, and freedom from other defects, and to submit any notices of defects in writing to Italian Coffee AG within 2 days of receipt; otherwise the corresponding warranty rights shall lapse.
This disclaimer of liability applies both to contractual claims and, to the extent permitted by law, to non-contractual claims as well.

Governing Law
Swiss law applies.

Place of Jurisdiction
The place of jurisdiction is the Zurich Commercial Court.
